These Terms and Conditions (“Terms”) govern all sales, services, installations, website use, monitoring services, and contractual relationships between Fire Beacon Solutions LLC (“Company,” “we,” “us,” or “our”) and any purchaser, municipality, agency, contractor, developer, property owner, or end user (“Customer,” “Client,” or “you”).
By purchasing, contracting, or using our products or services, you agree to these Terms.
1. Scope of Services
Fire Beacon Solutions LLC provides:

Fire hydrant visibility systems
-
Elevated reflective beacon systems
-
LED-enhanced visibility markers
-
Optional smart monitoring technology
-
Related consulting, compliance guidance, and infrastructure visibility solutions
Nothing in our services replaces required municipal inspections, fire code compliance inspections, or fire department authority oversight.
2. Compliance Responsibility
Customer acknowledges that:

Installation must comply with all applicable federal, state, municipal, fire code, and public works regulations.

Fire Beacon Solutions does not assume responsibility for permitting unless explicitly stated in a written agreement.

The Customer is solely responsible for verifying compliance with local authority having jurisdiction (AHJ).
We do not warrant that use of our products alone guarantees regulatory compliance.
3. Orders, Quotes & Payment
All quotes are valid for 30 days unless otherwise stated.
Orders are subject to acceptance and product availability.
For municipal or enterprise contracts, separate written agreements may supersede these Terms.
Late payments may accrue interest at the maximum rate permitted by law.
4. Installation & Site Responsibility
Unless explicitly contracted in writing:

Fire Beacon Solutions is not responsible for third-party installation errors.

We are not liable for improper mounting, code violations, underground utility conflicts, or site-specific hazards.

Customer assumes responsibility for ensuring hydrant access remains unobstructed.
Improper installation voids warranty protections.
5. Limited Warranty
We provide a limited warranty covering defects in materials and workmanship under normal use conditions.
Warranty does not cover:

Improper installation
-
Misuse or vandalism
-
Acts of nature
-
Unauthorized modifications
-
Damage from vehicle impact
Warranty remedies are limited to repair or replacement at our discretion.
6. Limitation of Liability
To the fullest extent permitted by law:
Fire Beacon Solutions LLC shall not be liable for:

Indirect damages

Incidental damages
-
Consequential damages
-
Loss of revenue
-
Loss of municipal funding
-
Regulatory fines
-
Insurance penalties
-
Business interruption
Our total cumulative liability shall not exceed the total amount paid by Customer for the specific product or service giving rise to the claim.
7. Indemnification
Customer agrees to defend, indemnify, and hold harmless Fire Beacon Solutions LLC, its officers, employees, contractors, and affiliates from and against any and all claims, damages, liabilities, losses, costs, or expenses (including attorney’s fees) arising out of:

Improper installation

Unauthorized modifications
-
Failure to comply with local codes
-
Site-specific hazards
-
Third-party injury claims
-
Misuse of products
-
Failure to maintain products
-
Failure to follow written instructions
This indemnification obligation survives termination of any agreement.
8. Insurance & Risk Allocation
Customer agrees to maintain appropriate general liability insurance coverage sufficient to cover installation and site-related risks.
Fire Beacon Solutions LLC maintains its own commercial insurance coverage consistent with industry standards; however, nothing herein expands our liability beyond the limitations set forth in these Terms.
Risk of loss transfers to Customer upon delivery unless otherwise agreed in writing.
9. Smart Monitoring & Data Services (If Applicable)
If Customer uses optional monitoring or wireless features:

Data transmission is not guaranteed to be uninterrupted or error-free.

We do not guarantee real-time emergency notification performance.
-
Monitoring tools are supplemental visibility tools only.
-
Customer remains responsible for required inspections and maintenance.
We are not liable for communication failures caused by:

Cellular outages
-
Internet disruption
-
Power failure
-
Third-party infrastructure failures
10. Force Majeure
Fire Beacon Solutions LLC shall not be liable for delay or failure to perform due to causes beyond reasonable control, including:

Natural disasters
-
Government action
-
Supply chain disruptions
-
Labor shortages
-
Transportation delays
-
Acts of war or terrorism
11. Intellectual Property
All designs, technology, branding, beacon systems, mounting structures, monitoring architecture, and proprietary configurations are the exclusive intellectual property of Fire Beacon Solutions LLC.
Unauthorized duplication or reverse engineering is prohibited.
12. Arbitration & Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms, products, or services shall be resolved by binding arbitration in the State of Arizona.
Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA).
The parties waive the right to:

Jury trial

Class action lawsuits
-
Consolidated proceedings
Each party shall bear its own legal fees unless otherwise determined by the arbitrator.
This arbitration clause survives termination of any agreement.
13. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
Venue for arbitration or permitted legal action shall be Maricopa County, Arizona.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
15. Modifications
We reserve the right to update these Terms at any time. Continued use of our website or services constitutes acceptance of revised Terms.
